Fiscal representation for non-residents in Portugal

If you live outside Portugal and hold a Portuguese tax number, the question is not whether fiscal representation exists in the abstract. It is whether your own situation triggers it. A flat in Lisbon triggers it. A tax number sitting unused in a drawer does not. This page works through the non-resident cases one by one, including the 15-day clock, the Golden Visa position, and the free alternative that many guides still leave out. For the general rules, start with our fiscal representative guide. For what each route costs, see our guide to fiscal representative costs.

Key takeaways

  • →Non-resident here means your tax address sits outside the European Union and the European Economic Area. The United Kingdom counts as outside, exactly like the United States or Canada.
  • →A non-resident with no Portuguese tax tie has no obligation at all. The obligation starts when a tie arises: Portuguese property, a Portuguese registered car, a Portuguese job, or self-employed activity in Portugal.
  • →Once a tie arises, you have 15 days to sort cover. That means appointing a representative or activating electronic notifications, except for self-employed activity, where a representative stays mandatory and must be in place when the activity is registered.
  • →Golden Visa holders who spend fewer than 183 days a year in Portugal stay non-residents for tax purposes, and their investment still counts as a tie. The visa card alone does not create tax residency, and it does not remove the representation question either.
  • →Representation is priced per person, not per household. A couple with Portuguese tax ties needs two appointments, and a child with their own tax tie needs their own appointment made by a parent.

First, what counts as non-resident here

The tax authority does not care where your passport was issued. It cares where your tax address sits. If that address is in a country outside the European Union and the European Economic Area, which means Norway, Iceland, and Liechtenstein alongside the EU members, then you are a third-country resident for this rule. An American living in New York, a Briton living in London, and a Canadian living in Toronto are all in the same position. A German living in Berlin is not, because Germany sits inside the area where representation has always been optional.

Tax residence is a separate question from immigration status, and confusing the two causes most of the mistakes on this topic. You can hold a Portuguese residence permit and still be a non-resident for tax purposes. You can also become a Portuguese tax resident without holding any particular visa, by spending more than 183 days in Portugal in a 12-month period or by keeping a home there in circumstances that show you mean to live in it as your usual home. The representation question follows the tax answer, not the card in your wallet.

The test, in plain terms

Ask two questions in order. The first is whether you live outside the EU and EEA for tax purposes. The second is whether you have a Portuguese tax tie. If the answer to either question is no, then the obligation does not bite. If the answer to both is yes, then you need cover, and the clock described below is already running. The table below applies that test to the situations people actually ask about.

Your situationCover needed?Why
Non-EU non-resident with Portuguese property, a car, a job, or self-employment in Portugal

Yes, within 15 days

A tax tie has arisen, so the tax authority needs a reachable contact in Portugal or an active electronic channel.
Golden Visa holder living fewer than 183 days a year in Portugal

Yes

Still a non-resident for tax purposes, with an ongoing investment tie to Portugal.
First NIF requested from abroad, as a non-EU citizen

Yes, in practice

The remote request normally goes through a representative, since electronic notifications need portal access you do not yet hold.
Non-EU non-resident with no Portuguese tax tie at all

No

With no tax relationship, there is nothing for a representative to represent.
EU or EEA citizen with electronic notifications activated

No

Electronic delivery replaces the proxy for citizens inside the area.
Moving to Portugal, NIF obtained before relocating, no property yet

Usually no

No ongoing tax relationship exists yet, so most people in this position do not need continuing cover.
Portuguese tax resident spending 183 days or more a year in Portugal

No

You are reachable directly at a Portuguese address, so no proxy is needed.

The 15-day clock, and what it really requires

The tax authority circular that first set out this rule, circular 90054 of June 2022, put the deadline at 15 days from the moment a tax tie arises. Buying a flat, registering a car in Portugal, signing a Portuguese employment contract, or starting self-employed activity all start that clock. The one timing exception is self-employed activity, where the representative must be in place at the moment the activity is registered, not 15 days later.

Older guides stop there and tell every non-resident with a tie to appoint a representative within 15 days. That was the position before July 2022, and it is now incomplete. Decreto-Lei 44/2022, in force from 9 July 2022, rewrote article 19 of the General Tax Law so that subscribing to an electronic notification channel discharges the duty just as appointing a representative does. A later circular, 90057 of July 2022, confirmed that reading and replaced the earlier one. So the honest version of the rule is that you have 15 days to sort cover, and cover can mean a representative or an active electronic notification subscription. The exception that survives untouched is self-employed activity subject to VAT, where representation stays mandatory no matter which channel you subscribe to.

There is a practical catch that keeps representatives in business despite the free route. You cannot activate electronic notifications until you hold Portal das Finanças access, and that access normally arrives as a password posted to the tax address on file, which for a new applicant abroad is usually the representative. So dropping a representative is a second step that happens weeks after the number arrives, not something you do on application day. Our guide to getting a NIF without a fiscal representative works through that sequence in full, including the one-way-door caveat that cancelling an electronic notification subscription later only takes effect once a representative is appointed first.

Do not confuse the clock with the fine

Fines for skipping compulsory cover run from €75 to €7,500, and the tax authority can also block you from exercising your rights before it until an appointment is made. In practice, though, the damage most people feel first is quieter. An IMI property tax bill sent to an address nobody monitors still falls due, and interest accrues whether or not anyone told you about it.

What the representative actually does for a non-resident

For someone living abroad, the representative is the address the tax authority can reliably reach. Tax letters, IMI bills, and deadlines arrive with the representative, who forwards them and keeps your tax address current. The representative can also exercise your rights before the tax authority, which covers claims, appeals, and challenges to tax decisions. What the representative does not do as a rule is pay your taxes for you. The one exception is self-employed activity subject to VAT, where the representative can share liability for the VAT due. That shared liability is a large part of why the VAT case keeps representation mandatory.

The distinction matters when you compare prices. A budget service that scans and forwards your mail is selling a reliable mailbox. An accountant or law firm that also files your returns is selling advice and filing on top of the mailbox. If your only Portuguese income is rent from one flat, the mailbox may be enough. If you also file annual returns and need someone to read Portuguese tax letters and tell you which deadline each one carries, the dearer tier earns its price. Provider by provider prices sit in our fiscal representative comparison, and the renewal arithmetic behind them sits in our guide to fiscal representative costs.

Golden Visa holders, in particular

Golden Visa holders are the group most likely to get this wrong in both directions. Some assume the residence permit makes them tax residents, so they drop their representative. Others assume the permit exempts them from tax admin altogether. Neither assumption holds. The permit requires only about seven days in Portugal in the first year and fourteen days in each later two-year period, which is far below the 183-day tax residence threshold. A holder who spends that little time in Portugal stays a non-resident for tax purposes, and the fund investment or property that qualified them for the permit still counts as a Portuguese tie.

The trap to watch is the habitual home test. If a Golden Visa holder rents or keeps a permanent home in Portugal in circumstances that show an intention to live there as a usual home, the tax authority can treat them as tax resident from early on, regardless of day count. At that point the representation question flips the other way, because a tax resident with a Portuguese address on file does not need a representative. The status follows the facts of where you actually live, not the label on the permit.

British citizens after Brexit

The United Kingdom counts as a third country for this rule, exactly like the United States or Canada. A British non-resident with a Portuguese property or car needs the same cover as an American in the same position, and the same 15-day clock applies when the tie arises. Brexit created no middle category. British citizens who already held a representative before the transition period ended were given a window to switch to electronic notifications without penalty, but that window closed at the end of 2022 and has no bearing on new appointments today.

One appointment per person

Representation is individual. If both partners in a couple are non-EU non-residents with Portuguese tax ties, both need appointments, and bundled NIF services usually price per applicant. Children are easy to overlook. A child with their own Portuguese tax tie, for example inherited property, needs their own appointment, made by a parent. The same per-person logic runs through the NIF itself, which is why our guide to NIFs for minors and families treats every child as a separate file rather than an addition to a parent file.

When the mandate ends

Cover ends when the reason for it ends, but ending it takes a formal step. Becoming a Portuguese tax resident and updating your tax address to a Portuguese one removes the need, since the tax authority can then reach you directly. Activating electronic notifications removes it too, provided no VAT-liable self-employed activity keeps representation mandatory. Selling the property, deregistering the car, or ending the Portuguese job removes the tie that created the duty in the first place.

In every case, the appointment itself must be cancelled formally and the cancellation confirmed as registered, rather than assumed from a stopped payment. A representative who resigns before a replacement is registered can leave tax mail in limbo, so a switch needs continuous cover with no gap. If cancelling follows a move to Portugal, check that the new Portuguese address is on file as well. Our guide to changing your NIF address covers the three move cases and the confirmation step that proves the new address actually landed.

One lifecycle deserves a sentence of its own, because it is where the money leak hides. A future resident appoints a representative for the remote NIF request, moves to Portugal, becomes tax resident, and then forgets to cancel the appointment. The renewals keep arriving, year after year, for a service that no longer serves any purpose. Put the cancellation in your calendar for the week you move, not for the month the next renewal invoice arrives.

A short decision checklist

First, confirm where your tax address sits, because that decides whether you are a third-country resident for this rule at all. Second, list your Portuguese ties honestly, including property, a car, employment, and self-employed activity, and note the date each tie arose, since that date starts the 15-day clock. Third, if a tie exists and you already hold portal access, check whether electronic notifications can carry you before you pay for a representative, unless VAT-liable self-employment rules that route out. Fourth, if you do appoint someone, get the renewal price in writing and confirm what the fee covers, since representation and tax filing are two different services. Fifth, diary the end of the mandate now, whether that end is a move to Portugal, a property sale, or a switch to electronic notifications, so the appointment does not outlive its reason.

If you are still unsure after that checklist, the deciding document is the remote filing route itself. Our guide to getting a NIF online as a non-resident shows how the first application normally runs through a representative, and why that first appointment is no proof that you need one forever.

Frequently asked questions

Does a non-resident always need a fiscal representative in Portugal?

No. A non-resident with no Portuguese tax tie has no obligation at all. The duty starts when a tie arises, such as Portuguese property, a Portuguese registered car, a Portuguese job, or self-employed activity in Portugal. EU and EEA citizens are in a different position again, since representation has always been optional for them.

How long do I have to appoint a fiscal representative?

15 days from the moment the tax tie arises, except for self-employed activity, where the representative must be in place when the activity is registered. Since July 2022, activating electronic notifications within that window discharges the duty just as appointing a representative does, except for VAT-liable self-employment, where representation stays mandatory.

I am a Golden Visa holder living outside Portugal. Do I need one?

Usually yes, as long as you stay a non-resident for tax purposes. Spending fewer than 183 days a year in Portugal keeps you a non-resident, and your qualifying investment still counts as a Portuguese tie. If you later become a tax resident and update your tax address to a Portuguese one, the need falls away.

Does Brexit change anything for British non-residents?

Only in that the United Kingdom now counts as a third country, exactly like the United States or Canada. A British non-resident with a Portuguese tax tie needs the same cover and faces the same 15-day clock. There is no middle category for British citizens.

Can I replace a fiscal representative with electronic notifications?

Yes, in most non-resident cases, since Decreto-Lei 44/2022. You subscribe to an electronic notification channel on the Portal das Finanças, through ViaCTT, or through the single digital address system. The catch is practical: you need portal access first, which usually arrives via the representative, so the switch happens weeks after the NIF arrives. VAT-liable self-employment is excluded from this route.

What happens if I skip a fiscal representative when one is required?

Fines run from €75 to €7,500, and the tax authority can block you from exercising your rights before it until an appointment is made. In practice the most common damage is missed tax mail, such as IMI bills and deadlines that keep running whether or not anyone forwarded them to you.

When can I cancel my fiscal representative?

When the reason for it ends: you become a Portuguese tax resident and update your tax address, you activate electronic notifications with no VAT tie keeping representation mandatory, or the tie itself ends, such as a property sale. Cancel formally and confirm the cancellation is registered instead of simply stopping payment.
