Fiscal representative for property owners in Portugal
Buying a home in Portugal creates a tax relationship with the Portuguese tax authority, even if you never live there. If you live outside the European Union and the European Economic Area, that relationship usually means you must appoint a fiscal representative, or switch on electronic tax notifications, within 15 days of the purchase. This page covers what the representative does for an owner, what the annual tax calendar looks like, what it costs, and what happens if you skip it. For the full rules on who must appoint a representative, start with our fiscal representative guide.

Key takeaways
- →Owning Portuguese property creates a tax relationship with the tax authority. A non-EU non-resident owner must appoint a fiscal representative or activate an electronic notification channel within 15 days of the tie arising.
- →The representative receives your IMI and AIMI bills, rental income correspondence, and any audit queries, and files returns and appeals on your behalf. The representative is not normally liable to pay your taxes.
- →IMI is charged to whoever owned the property on 31 December, at 0.3 to 0.45 percent of the official tax value for urban property. The bill arrives by the end of April and is paid in May, August, and November depending on the amount.
- →Representation is per person, not per household. Joint owners each need their own appointment, and a child who inherits Portuguese property needs one too, arranged by a parent.
- →Skipping a compulsory representative carries fines of 75 to 7,500 euros. In practice the common damage is simpler: missed IMI bills, blown deadlines, and interest.
The short answer
The rule turns on one fact. The Portuguese tax authority treats owning real estate in Portugal as a tax relationship, and a tax relationship triggers the duty to be reachable. A non-EU non-resident owner meets that duty in one of two ways. You appoint a fiscal representative based in Portugal, or you subscribe to one of the electronic notification channels on the Portal das Finanças. Either route satisfies the law. The representative is the older route, and it is the one most owners still use, because it also puts a person between you and the paperwork.
The duty does not depend on how much time you spend in the property. A holiday flat you visit for two weeks a year creates the same obligation as a house you rent out full time. It does not depend on the value of the property either. A modest apartment in the Algarve and a villa in Cascais trigger the same 15-day clock. What matters is the ownership itself, and where you live.
EU and EEA citizens are in a different position. Since the European Court of Justice ruled in 2011 that Portugal could not force EU nationals to appoint a representative, an owner who lives in the EU or the EEA does not need one. The same goes for a Portuguese national living in the EU. A British owner, on the other hand, counts as a third-country national since Brexit, exactly like an American or a Canadian.
The 15-day clock
The clock starts when the tax relationship arises. For a buyer, that is the purchase itself, when the property passes into your name. The tax authority gives you 15 days from that point to appoint a representative or activate an electronic notification channel. The official guidance from the Portal das Finanças states the same 15 days for a taxpayer who changes their tax address to a country outside the EU or EEA while already owning Portuguese property.
In practice, most buyers sort this out before completion rather than after it. The lawyer handling the purchase often flags it, and the representative appointment can be filed alongside the other completion paperwork. That is the sensible order, because the first tax mail can arrive sooner than people expect. If you buy in March, the IMI bill for the previous owner still goes to them, since IMI is charged to whoever owned the property on 31 December of the previous year. Your first bill arrives the following spring, but correspondence about the purchase itself can start earlier.
One timing rule is stricter still. If you plan to carry out a VAT-liable activity in Portugal, such as running a short-term rental business that is liable to VAT, you must appoint a representative before the activity begins, not within 15 days of starting it. And for that activity, the electronic notification route does not work at all. Representation stays mandatory.

What your representative handles for an owner
A representative is your point of contact with the tax authority, and for a property owner that contact covers more than one tax. The table below sets out the main items, what the representative does with each one, and when it lands.
| Item | What the representative does | When it lands |
|---|---|---|
IMI property tax bills | Receives the annual collection note and tells you the amount and the payment dates before the deadline passes. | Bill by end of April; payment in May, August, and November depending on the amount. |
AIMI, the additional property tax | Receives the separate AIMI note for high-value holdings and flags it, since it arrives months after the IMI bill. | Note by end of August; payment due by end of September. |
Rental income tax | Files the annual return for rent received, with the Category F annex, and handles the rent receipts the law requires. | Return filed between 1 April and 30 June for the previous year. |
Selling the property | Receives the capital gains assessment and any queries from the tax authority, and can file appeals on your behalf. | At sale, and for the return covering the year of the sale. |
Other tax correspondence | Receives every letter from the tax authority, including audit queries and deadline notices, and exercises your right of reply. | All year. Replies to tax notices are often due within 10 to 15 days. |
Two points about that job are worth stating plainly. First, the representative receives the mail and files the paperwork, but the taxes themselves remain yours. As a rule, a representative is not responsible for paying your taxes. The exception is narrow: a representative can be jointly liable for VAT where the non-resident carries out an independent activity subject to VAT. Second, the representative can exercise your rights before the tax authority, including filing administrative complaints and appeals. That matters when an assessment looks wrong, because appeal deadlines are short and a missed one is hard to recover.
The annual tax calendar for an owner
Owning the property means paying tax on it every year, and the calendar has three separate dates to keep. The rates are the same for residents and non-residents. There is no surcharge for foreign ownership. The difference is purely practical: a resident gets the bill at home, while a non-resident owner abroad needs someone in Portugal to receive it.
| Tax | Rate | When it is due |
|---|---|---|
IMI, the annual municipal property tax | 0.3 to 0.45 percent of the VPT for urban property, set by the municipality. Rural property is taxed at 0.8 percent. | The bill arrives by the end of April. Up to 100 euros is paid once, by 31 May. Between 100 and 500 euros is paid in two instalments, by 31 May and 30 November. Over 500 euros is paid in three, by 31 May, 31 August, and 30 November. |
AIMI, the additional tax on high-value homes | Individuals pay 0.7 percent on the slice of combined residential VPT above 600,000 euros, 1 percent above 1 million, and 1.5 percent above 2 million. Couples filing jointly shield the first 1.2 million euros. | The payment note is issued by the end of August, and payment is due by the end of September. |
Rental income tax | Residential rental income is taxed at an autonomous rate of 25 percent. Longer residential leases can qualify for reduced rates. | Rent receipts are issued for each payment, an annual income declaration is due by the end of February, and the Modelo 3 return is filed between 1 April and 30 June. |
A note on the IMI calculation, because it surprises first-time buyers. IMI is charged on the VPT, the Valor Patrimonial Tributário, which is the property official tax value set by the tax authority. It is not charged on the price you paid. The VPT is usually lower than the market price, which is why the annual bill is often smaller than people expect. The municipality sets the exact rate each year inside the national band, so the same property can cost slightly more or less from one year to the next.
AIMI works the same way, on combined VPT rather than market value. The 600,000 euro threshold applies per taxpayer, across all residential property they own in Portugal, not per property. A single apartment in Lisbon and a small house in the Algarve held in one name can together cross the line. Married couples and civil partners who file jointly can pool their allowance and shield the first 1.2 million euros.
Who needs one, and who does not
The rule follows the owner, not the property. A non-EU non-resident who owns Portuguese property needs a representative or an activated notification channel. An EU or EEA resident who owns the same property does not. A Golden Visa holder who lives in Portugal for fewer than 183 days a year is treated as a non-resident with ongoing ties, so the duty applies to them as well. Our guide for non-residents works through every scenario, including people who move away from Portugal and people who move there.
Joint ownership is where families get caught out. Representation is per person, not per household. If a husband and wife own a flat together and both live outside the EU, each of them needs their own appointment. One spouse representative does not cover the other. The same applies to children. A child who inherits Portuguese property has their own tax tie, and needs their own representative, appointed by a parent. Our guide to NIF numbers for minors and families covers the family side in full.
Owning property does not make you a Portuguese tax resident. Tax residency turns on spending more than 183 days in Portugal in a 12-month period, or having your main home there. A non-resident owner is taxed in Portugal only on Portuguese-source income, which is why the representative duty and the tax bill both exist without residency. If you later move to Portugal and become a tax resident, the duty ends, because you are reachable directly. You update the tax address on your NIF, as our guide to changing your NIF address explains, and cancel the appointment.
What it costs
The price of representation for an owner is the same as for any other non-resident. Bundled NIF and representation packages run 79 to 99 euros for the first year, renewing at 79 to 149 euros a year. Standalone budget services start from around 99 euros a year. Accountants and law firms charge 150 to 400 euros a year, often with tax return filing included. The electronic notifications route costs nothing. The full bands, and the renewal trap to watch for, are on our fiscal representative cost guide. The short version is to price the renewal, not the headline. A 79 euro first year that renews at 149 euros costs more over three years than a 95 euro service that renews at 79 euros, so get the renewal figure in writing before you buy.
For an owner, the cheapest option is not always the cheapest service. A representative who only forwards mail is fine if you file your own returns. An owner who rents the property out, or who holds it through a company, usually needs filing as well, and that is where the accountant tier earns its fee. Compare the options side by side on our fiscal representative comparison.
The free alternative: electronic notifications
Since July 2022, a non-EU non-resident owner can skip the representative entirely by subscribing to an electronic notification channel. The waiver covers property owners too, and it costs nothing. The three accepted channels are the notifications system on the Portal das Finanças, the ViaCTT electronic mailbox, and the public notifications service tied to the single digital address. Any one of them does the job.
There is a sequence catch that matters for owners who have just bought. You cannot activate a channel until you can log in to the Portal das Finanças, and the portal password arrives by post at the tax address on file, usually through your representative. The standard wait is 5 to 10 business days, and activation itself then takes effect in monthly batches. If you buy and immediately need coverage, appointing a representative first and switching to notifications later is the safer order. Our guide to electronic tax notifications walks through the steps and the confirmation check.
What happens if you skip it
The fine for failing to appoint a representative when one is compulsory runs from 75 to 7,500 euros, depending on the circumstances. The tax authority can also invalidate your NIF or freeze property transactions, and you lose the right to appeal tax decisions you never saw. Those are the formal consequences, and they are real, but the damage most owners actually suffer is quieter. A missed IMI bill means a missed deadline, and a missed instalment makes the rest of the year amount due at once, with interest. A notice about a rental return that nobody answers becomes an assessment made without your input.
The pattern is the same in almost every case. The owner bought the property, filed the paperwork, and assumed the tax side would find them. It does not. The tax authority writes to the address on file, and if that address is a foreign home with no representative in Portugal, the mail either arrives late or never arrives at all. The 15-day appointment is the fix, and it costs far less than a single fine.
When the duty ends
The duty lasts as long as the tie lasts. Sell the property and settle every outstanding obligation, and the requirement ends with it. Move to Portugal and become a tax resident, and it ends because you are reachable directly. Activate electronic notifications with no VAT tie keeping representation mandatory, and it ends that way instead. In every case, end it formally. Cancel the appointment through e-Balcão and confirm the cancellation is registered. Never just stop paying, because the appointment stays on your record and the fees keep coming. Our guide to cancelling or changing a representative covers the steps, including the timing for a switch with no gap in coverage.
Three traps to avoid
Buying the property and forgetting the 15 days. Completion day starts the clock, not the day the first tax bill arrives. Sort the appointment or the notification channel alongside the purchase paperwork, and the deadline takes care of itself.
Assuming one appointment covers the household. Joint owners each need their own representative, and a child who inherits property needs one too. A single appointment in one name leaves the other owners unrepresented and exposed to the same fines.
Stopping payment instead of cancelling. If you sell up or move to Portugal, cancel the appointment properly and confirm it is registered. A representative you stopped paying is still your representative on the tax authority record, and the fees keep accruing until the cancellation lands.

Frequently asked questions
Do I need a fiscal representative if I own property in Portugal but live abroad?
Usually, yes, if you live outside the EU and the EEA. Owning Portuguese property creates a tax relationship with the tax authority, and a non-EU non-resident with a tax relationship must appoint a fiscal representative or activate an electronic notification channel within 15 days. EU and EEA residents who own Portuguese property do not need one. Since July 2022, electronic notifications are a free alternative to a representative for most owners.
How long do I have to appoint a fiscal representative after buying property in Portugal?
15 days from the moment the tax relationship arises, which for a buyer is the purchase itself. The same 15 days apply if you change your tax address to a country outside the EU or EEA while already owning Portuguese property. If you plan a VAT-liable activity, such as a short-term rental business liable to VAT, you must appoint a representative before the activity begins.
What does a fiscal representative do for a property owner?
The representative receives all tax correspondence, including IMI and AIMI bills, rental income notices, and audit queries, and tells you what is due and when. The representative can also file your annual IRS return with the Category F annex for rental income, and file complaints and appeals on your behalf. As a rule, the representative is not responsible for paying your taxes, with a narrow exception for joint VAT liability on independent VAT-liable activity.
Can I use electronic notifications instead of a fiscal representative as a property owner?
Yes, in most cases. Decreto-Lei 44/2022 lets a non-EU non-resident owner skip the representative by subscribing to one of three electronic notification channels: the Portal das Finanças notifications system, the ViaCTT electronic mailbox, or the public notifications service tied to the single digital address. The catch is the sequence. You need Portal das Finanças access first, and the password arrives by post, usually in 5 to 10 business days, so appointing a representative first and switching later is often the safer order.
What happens if I do not appoint a fiscal representative as a property owner?
Fines run from 75 to 7,500 euros. The tax authority can also invalidate your NIF or freeze property transactions, and you lose the right to appeal decisions you never saw. In practice, the most common damage is missed IMI bills and blown deadlines. A missed instalment makes the rest of the year amount due at once, with interest.
Does my spouse need their own fiscal representative if we own property together?
Yes. Representation is per person, not per household. Each joint owner who lives outside the EU and the EEA needs their own appointment. The same applies to a child who inherits Portuguese property. The child needs their own representative, arranged by a parent.
When does the fiscal representative duty end for a property owner?
When the reason for it ends. Sell the property and settle every outstanding tax obligation, and the requirement ends. Move to Portugal and become a tax resident, and it ends because you are reachable directly. Activate electronic notifications with no VAT tie keeping representation mandatory, and it ends that way instead. In every case, cancel the appointment formally through e-Balcão and confirm the cancellation is registered, rather than simply stopping payment.
